Malpractice Issues

  • NM Statute of Limitations is 2 years from the time the harm is discovered (for a minor age 18 + 2 years); for non-state entities, the Statute of Limitations is 3 years. When the harm is discovered can vary significantly from the time the care was provided
  • Other states have “caps” on damages recoverable; these vary from state to state
