Elements in a Medical Malpractice Action

To establish a claim for negligence or malpractice, a plaintiff is required to prove the following elements:

That the plaintiff was owed a duty
That the physician breached the duty
That the breach of duty was the proximate cause of the injury
That the plaintiff suffered damages related to the injury
