Elements in a Medical Malpractice Action

To establish a claim for negligence or malpractice, a plaintiff is required to prove the following elements:

  • That the plaintiff was owed a duty
  • That the physician breached the duty
  • That the breach of duty was the proximate cause of the injury
  • That the plaintiff suffered damages related to the injury
