Federal law requires that hospitals with a dedicated
emergency rooms must:
- Provide a Medical Screening Examination to every
patient who comes to the hospital requesting emergency examination
or treatment
- Provide the patient with the necessary stabilizing
treatment that is within the capabilities of the hospital until
the patient is stable for transfer or discharge

These services must be provided to each patient regardless
of the patients financial condition

In addition, the hospital cannot delay the treatment
to inquire about the patients insurance or financial status
