EMTALA

  • Federal law requires that hospitals with a dedicated emergency rooms must:
    • Provide a Medical Screening Examination to every patient who comes to the hospital requesting emergency examination or treatment
    • Provide the patient with the necessary stabilizing treatment that is within the capabilities of the hospital until the patient is stable for transfer or discharge
  • These services must be provided to each patient regardless of the patient’s financial condition
  • In addition, the hospital cannot delay the treatment to inquire about the patient’s insurance or financial status
