Psychiatric and Demented Patients

  • If they have a "Durable Power of Attorney For Health Care" executed prior to Legal Incapacity the “Agent” can consent
  • If they have a "Treatment Guardian", the Guardian can consent for psychiatric care
    • Not all Guardians can consent for treatment
    • Guardians and agents must be notified
  • Suicidal/Homicidal/Gravely Disabled (unable to care for self) cannot refuse treatment needed to avoid suicide, homicide, starvation
  • Otherwise the "Usual Rules" apply
    • If able to understand risks/benefits/alternatives they can consent
